After this month the issue of whether a sportsbook could open up in the former Garden State Park racetrack in Southern New Jersey might be answered.
A New Jersey judge should issue a ruling in the case of developer Cherry Hill Towne Center Partners versus Greenwood Running in August.
Cherry Hill is currently hoping to start an sports betting centre where the Garden State Park racetrack stood. Greenwood is the owner of Garden State Park. It stays opposed to anybody else.
The crux of the problem revolves around that gets the rights to take wagers Greenwood or even the Cherry Hill programmers.
Back in August 2018, when sportsbooks just got off the floor, the Cherry Hill programmers began making rumblings.
But GS Park Tours Greenwood Racing, has claimed it holds restrictive covenants.
The programmers back in March appeared to be moving ahead with standalone sportsbook plans while the site is currently a retail , restaurant, and residential housing complex.
Greenwood Racing promptly sent a letter to Judge Renee Marie Bumb, stating as Garden State Park was in the midst of litigation, that the developers were out of line.
There’s nothing preventing Cherry Hill gambling facility.
The NJ sports betting laws passed in 2014 allow for lively NJ racetracks, Atlantic City casinos, along with two racetracks that are shut, including Atlantic City Racetrack and Garden State Park, to apply for sports. The prior racetracks had to get held a race there in the 15 years prior to the law was passed.
Garden State Park held its last race on May 3, 2001, making it barely qualified.
The issue is, who has the right to accept sports bets there?
Greenwood claims it retains exclusive rights to accept all and any wagers on the property. Cherry Hill says legal sports was not a part of the equation when Greenwood was allowed rights. According to Cherry Hill, that leaves those rights unenforceable and invalid.
Cherry Hill has redeveloped the site into a mixed residential and business zone. Thus, it figures it has the right to get exactly what it wants there.
Confusing items is the fact that both sides are in on the emerging legal US sports company elsewhere.
Greenwood Racing has established a sportsbook at Parx Casino in Pennsylvania. Additionally, it opened two at two off-track betting facilities it owns and works in the Philadelphia region.
In the meantime, Jack Morris is among the flaws supporting Cherry Hill Towne Center Partners. He is also a part owner before this season of Hard Rock Atlantic City, which opened up a sportsbook that is retail.
Cherry Hill filed papers claiming that it had been close to finalizing a deal with a company operating an NJ sportsbook last month.?? Cherry Hill also composed it should be able to make an application for an NJ sports betting license regardless of the asserts of Greenwood.
Greenwood argued that Cherry Hill should not have the ability to submit an application for a permit without consideration of the lawsuit. Plus, it needs the best.
Cherry Hill Towne Center Partners says it could have the sportsbook ready to go within 90 to 120 days. The site is just off Route 70, less than 10 miles.
